1. Acceptance of Terms
By accessing or using PipsCrusher ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. PipsCrusher reserves the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.
2. Description of Service
PipsCrusher is a forex signal generation and trade automation platform. We provide AI-generated trading signals, a MetaTrader 5 Expert Advisor for automated trade execution, and a web-based dashboard for portfolio management. PipsCrusher is not a broker, financial advisor, or investment manager. We do not hold client funds, execute trades on our own accounts, or provide personalized investment advice.
3. Account Registration
To use the Service, you must register an account with a valid email address and create a secure password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must be at least 18 years old to create an account. You agree to provide accurate and complete information during registration and to keep your account information up to date.
4. Subscription Plans & Billing
PipsCrusher offers tiered subscription plans with varying features and pricing. Subscription fees are billed in advance on a recurring basis (monthly, quarterly, semi-annually, or annually depending on the plan selected). Prices are displayed in USD and/or NGN. You authorize us to charge your chosen payment method at the start of each billing cycle. All fees are non-refundable except as described in our Refund Policy.
5. Trading Risk Disclaimer
Trading foreign exchange involves substantial risk of loss and is not suitable for all investors. Past performance of signals or strategies does not guarantee future results. You acknowledge that you are solely responsible for any trading decisions you make, whether manual or automated through our Expert Advisor. PipsCrusher shall not be liable for any financial losses incurred as a result of using the Service.
6. Acceptable Use
You agree not to: (a) share your account credentials or API keys with unauthorized parties; (b) reverse-engineer, decompile, or redistribute the Expert Advisor code; (c) use the Service for any illegal or unauthorized purpose; (d) attempt to circumvent plan feature limits or access controls; (e) interfere with or disrupt the Service infrastructure; (f) resell, sublicense, or redistribute signals or data obtained through the Service.
7. Intellectual Property
All content, code, algorithms, strategies, and materials provided through PipsCrusher are the intellectual property of PipsCrusher and are protected by copyright, trademark, and other applicable laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the Service and Expert Advisor for personal trading purposes only.
8. Data Privacy
We collect and process personal data in accordance with our Privacy Policy. By using the Service, you consent to the collection, use, and storage of your data as described in the Privacy Policy. We do not sell your personal information to third parties.
9. Service Availability
While we strive for 99.9% uptime, PipsCrusher does not guarantee uninterrupted access to the Service. We may perform scheduled maintenance, updates, or experience unforeseen outages. We are not liable for any losses resulting from service interruptions, delayed signal delivery, or EA connectivity issues.
10. Limitation of Liability
To the maximum extent permitted by law, PipsCrusher and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the preceding 12 months.
11. Termination
We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, or any conduct we deem harmful to the Service or its users. You may cancel your subscription at any time from your dashboard. Upon cancellation, you retain access until the end of your current billing period.
12. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or the use of the Service shall be resolved through binding arbitration or in the courts of the relevant jurisdiction.
